A roundtable was held to discuss the draft Law of Ukraine "On Amendments to Certain Laws of Ukraine Regarding the Implementation of Open Science Principles."

On April 24, 2025, at the State Organization "Ukrainian National Office for Intellectual Property and Innovation" (UKRNOIVI), a roundtable discussion was held to consider the draft Law of Ukraine "On Amendments to Certain Laws of Ukraine Regarding the Implementation of Open Science Principles," which had been published for public consultation by the Ministry of Education and Science of Ukraine on March 7, 2025.

The discussion involved representatives of research institutions and higher education establishments, the drafters of the law, and representatives of the Ministry of Education and Science of Ukraine, including:

  • Director of UKRNOIVI, Academician of the National Academy of Legal Sciences of Ukraine (NALSU), Doctor of Law, Professor O. Orlyuk;

  • Deputy Director, Ph.D. in Law L. Maidanyk;

  • Director of the Research Institute of Intellectual Property of the NALSU, Ph.D. in Law O. Doroshenko;

  • Director of the Center for Intellectual Property Studies and Technology Transfer of the National Academy of Sciences of Ukraine, Doctor of Law Y. Kapitsa;

  • Head of the Department of Intellectual Property and Information Law of the Educational and Scientific Law Institute of Taras Shevchenko National University of Kyiv, Doctor of Law, Professor A. Kodynets;

  • Doctor of Law, Professor, First Vice-Rector of Vadym Hetman Kyiv National Economic University A. Omelchenko;

  • Doctor of Law, Head of the Copyright and Related Rights Department at the Research Institute of Intellectual Property of the NALSU A. Shtefan;

  • Deputy Director-General of the Directorate of Science Development — Head of the Expert Group on Open Science and Evaluation Systems (Directorate of Science Development) O. Prudka;

  • Associate Professor of the Department of Civil Law at Yaroslav Mudryi National Law University, Ph.D. in Law B. Karnaukh;

  • Associate Professor of the Department of Social Communications and Information Activities at the Institute of Humanities and Social Sciences of Lviv Polytechnic National University, Ph.D. in Technical Sciences O. Berezko, and others.

Experts from the State Organization "Ukrainian National Office for Intellectual Property and Innovation," institutions of the NALSU, the NAS of Ukraine, and Taras Shevchenko National University of Kyiv noted that the draft law requires amendments taking into account the practices of implementing open science and open access to research results in the European Union, the conditions and practices of using Creative Commons licenses, as well as the experience of implementing open science in Ukrainian research institutions and higher education establishments.

It was also emphasized that Ukraine’s preparation for accession to the EU in the field of intellectual property should be taken into account, along with related draft amendments to Ukrainian legislation being developed in this area, and that provisions conflicting with EU legislation and practices should be avoided.

It was proposed to establish a joint working group to refine the draft law.
